I really hate America&#039;s uberlaw system, which is totally flawed, corrupt and most of all unconstructive. WAht&#039;s with the jury&#039;s anyway?

You eat too many burgers? SUE!
You killed your classmates after a dumb movie? SUE!
You drank your coffee too fast and got burned? SUE!

In all other countries this sounds totally ridiculous, and it is. Lets hope America will reduce their silly lawyer army in the upcoming tight years for them.</description>

No Imersion won a jury award in the main trial. The woman judge refused to hear any futher arguments from Sony. Sony had gone through exhaustive Patent Research and found a prior Patent holder to the invention of rumble technology. They then paid this patent holder for using their patent in recognition of him being the proper technology patent owner.

The judge refused to let this rightful patent holder testify on Sony&#039;s behalf. Sony appealed and the appeal was upheld by a subsequent re-hearing as they had to use the evidence that had been submitted in the trial. She mistakenly misjudged it as a paidoff testimony. It is still in the process of Patent litigation to establish it as the rightful Patent to this technology.

If he is found to legally hold the real patent, Imersion will be sued as his Patent will supersede theirs. Sony has appealed for retrial. Which has been granted. This is why Sony is withholding all payments to Imersion. At the same time if Sony would have used Imersion Rumble Technology, they would have more than likely been in contempt of the injunction against using it, and would have had to remove all PS3&#039;s from market. They couldn&#039;t take the chance. Now other feedback patent holders are suiing just Nintendo and Microsoft as they are the only ones using feedback or haptek technology.

Expect this to all get very hairy before it&#039;s all over. As if it wasn&#039;t already! But yes, Sony could very well win this appeal under a different judge. So since Imersion is not really worth much right now after Microsoft sold their shares back it looking grimmer by the day. Imersion is on the verge of bankrupsy again and can ill afford to even be in court against Sony. Since Imersion has no power to collect the original jury award from Sony! Imersion&#039;s value is less than half of the jury awarded them. What a joke! Want to get rich? Sue somebody!</description>

I think it&#039;s a bad thing that the good ol&#039; usa imported, the right to be able to sue for incredulous amounts of money. Law is more than anywhere else a big business there, and the whole world suffers from it.

They did it against IBM, one too many times now and are paying the price.

Microsoft got caught in the recent IBM vs SCO (Unix) lawsuit. That lawsuit over Linux is now dead and IBM has canceled all Windows license renewals (1000&#039;s). They dropped all their plans to buy Vista and now will just be using Linux. Motorolla did the same thing then, after seeing what M$ did to their partner. They have been followed by other large Corporations dropping Windows license renewals and buying Vista. Don&#039;t expect Vista to make half the splash now that Microsoft has been exposed for who they are and how they operate! Notice now on Moto Phones, they have their new Linux OS running. Many Many more cell phone companies are now choosing Linux as well. HP and Dell now offer Linux along with many others. BTW Moto&#039;s new Linux phones are Killer interfaces!
