Microsoft Sued Over Scratched Discs
Jorge Brouwer, from Florida, filed a lawsuit against Microsoft for, get this, a design flaw that caused some of his game disks to be irrecoverably scratched. Brouwer complains that the 360 can wreck discs even under normal circumstances. His lawyer, Jeffrey Ostrow, also puts out the argument that Microsoft doesn’t inform the consumer that moving the 360 while a disc is inserted can damage the disc.
So what is this humble gamer asking Microsoft to pay in reimbursement? A mere $5 million, at least. Don’t get too excited, there is no chance what-so-ever that he will be payed that amount ever. To be fair, Microsoft has replaced the games of his that were specifically published by Microsoft. Of course, they charged him $20 per disc, but hey, they’re Microsoft.

Now, if the moron didnt ask for 5 million… I swear people are f(((king retarded and looking for the easy way out of things in life. They easily wouldve of said okay we ll replace it. I dont blame them there, 5 million for 1000 bucks worth of stuff?

In the lawsuit, the Plaintiff is asking the Court to certify a nationwide class and create a fund for all individuals that have had discs damaged by an Xbox 360. The Plaintiff has alleged that the total minimum amount of damages incurred by all of the individuals combined is at least $5,000,000.00. To be clear, the Plaintiff is not alleging that he or any individual member of the class is entitled to that amount of money. The sum recovered by individual class members will be significantly less than the total damages incurred by the proposed class as a whole.
