You may remember a while ago that Silicon Knights sued Epic for providing Silicon Knights, and other developers, a model of the Unreal Engine 3 that was essentially broken. A few days ago, Epic made a counterclaim to Silicon Knights stating that they didn’t have merit for their claims, and that it is merely a way to siphon money for Too Human.
“SK’s lawsuit is a pretense. SK does not have any valid claims against Epic. SK filed suit in a bid to renegotiate the License Agreement, in the hope that Epic will prefer that to the burden of responding to discovery and associated adverse publicity.”
Now Silicon Knights is responding to that counter with a counter of their own. Silicon Knights’ Lawyer Cris Holland claims that, bear with me, Epics counterclaim that Silicon Knights’ claims have no merit, isn’t valid and has no merit itself, and that Silicon Knights wont make a profit from Epic, it will simply cover it’s losses.
“We don’t think Epic’s counterclaim has any merit. We believe strongly that our claims in our complaint will prevail and the damages Silicon Knights has suffered in connection with its original complaint are vastly more, millions of dollars more than what Epic claims its damages are in its counterclaim. They’ve set forth $650,000 and our claims will dwarf that substantially.”
Holland also said that Too Human wasn’t at E3 because Silicon Knights will hold their own event(SilCon?) to show the game to the public.

1I knew Epic was going to do something … the info they have stated really looks bad for SN. I don’t know what is going to happen with their game … they may be ruining their reputation and turning off gamers and this whole lawsuit thing could really cause the game to be delayed or worse … cancelled. I hope not though because I was really looking forward to Too Human … it really sounded like an interesting idea and if they don’t do it someone else is going to take their basic idea and run with it.

2Nope, nothing has happened to it. They’ve made their own engine out of the UE3, We’ll still see Too Human around the first half of next year. I’m definitely getting it at launch, provided it doesn’t come out after Spore.

3Take a look at Rainbow Six Vegas; it was powered by the Unreal Engine 3, yet it came nowhere near Gears of War in terms of visual quality. The PC version of R6V was even worse, and could have been done with Unreal Engine 2.5.
It may have been that the developers simply weren’t good enough with the engine, or didn’t have enough time, but it might have happened that Epic didn’t do their job.
On the other hand, look at Bioshock… stunning.

4Yeah it is something when you look at Bioshock and Mass Effect you have to wonder what SK is talking about but it is something that will have to play out before full judgements can be made.

5[...] As you may or may not know, Digital Battle has been following the legal battle between Silicon Knights and Epic for a while now. Epic has tried to play cool and simply dismiss the accusations made by Silicon Knights. For those of you who haven’t been following this here’s the summary. Silicon Knights has a conspiracy theory that Epic isn’t holding up it’s side of the deal with those developers who have licensed the Unreal Engine. Silicon Knights is now demanding to know what Epic’s version of the Unreal Engine has that makes Gears Of War work better than another games using the licensed technology, like say, Too Human.
